Chiropractor trying to retro my bill

My chiro suddenly informed me due to clerical error since 2009, the clerk did not file my insurance properly and would now like me to pay $400 in back co-pays, even though my two insurances were covering most of the bill. They admitted that they should have caught the mistakes MUCH earlier but didn’t catch it until now! What are my options?

LadyBugg – thanks for visiting the site and posting your question. It sounds like your chiropractor needs to get his act together! Its unfortunate that these copays are only coming up now, but it’s not clear that that relieves you from having to pay them. You should first call your insurance company and find out if what the chiro is telling you is accurate. Was there, in fact, copays due for your visit or not? This should have been disclosed to you. If the copays are required, then you will probably have to pay up. If they are not, then you should correct the chiro. Either way, make sure to take detailed notes of who you talked to at the insurance company and when. I hope this helps! Good luck.

I actually spoke with a lawyer today and she said that it was unfortunate since the law wasn’t protecting the consumer. She gave me a few options and said he was probably offering that I only have to pay half the bill because he was avoiding any type of legal action. The chiro probably is trying to avoid court because he would have to answer to the judge for what he was doing. I did make an offer to the chiro and said I would stop at the office and pay $100 in cash to call it good. He refused and asked for $200. I said I would get back with him later. They are sounding very contrite about the whole thing and I was assured they would not send it to collections. I’m going to try one more thing in January. The lawyer told me to send the check for $100 in the mail stating that it was my offer and for them to close my account as paid in full. If they cashed the check, then it’s seen as an agreement to my letter. We shall see!
